KVKK Compliance & Audit

We guide you in putting technical and administrative measures into practice so that you fully meet your obligations under KVKK (Turkish Personal Data Protection Law). We help you achieve full compliance, minimize the risk of data breaches and stay protected from KVKK sanctions.

Overview

The Personal Data Protection Law (KVKK), Law No. 6698, imposes comprehensive obligations on all natural and legal persons that process personal data. Organizations acting as data controllers must document the legal basis for data processing, inform data subjects, ensure data security through technical and administrative measures and, in the event of a breach, notify the Personal Data Protection Board (KVKK Board).

A KVKK compliance program covers two core dimensions: administrative measures and technical measures. Administrative measures include establishing policies and procedures, employee training, supplier contract management, privacy notices and maintaining a data processing inventory. Technical measures cover technology controls such as access control, encryption, secure deletion, DLP and monitoring infrastructure.

A Data Protection Impact Assessment (DPIA/KVKK impact analysis) is mandatory for high-risk data processing activities. Conducting a DPIA before new system deployments, large-scale data processing projects or projects involving sensitive data categories is both a legal requirement and a risk management best practice. Indexline carries out the methodology, documentation and technical assessment aspects of this process.

Beyond the administrative fines set by the Board, a KVKK violation also causes serious reputational damage and loss of customer trust. With the criminal provisions under Article 17 and its civil liability dimension, KVKK poses a genuine legal risk for organizations. At the same time, a compliance program does more than reduce risk; it also creates organizational value by raising personal data management maturity.

How It Works

1

Compliance Gap Analysis: Current data processing activities, technical controls and policies are compared against KVKK requirements. Gaps are identified and risk-scored.

2

Data Inventory and Mapping: Personal data processing activities are documented under RoPA (record-keeping obligation). Data flows are mapped.

3

Policy and Procedure Development: A personal data processing policy, data breach response plan, supplier assessment procedure and data subject request process are created.

4

Technical Measures Implementation: Technical controls such as access control, encryption, DLP and log management are configured in line with KVKK requirements.

5

Privacy Notices: Texts are prepared to meet notification obligations on the website, mobile application and physical locations.

6

Employee Training: All staff complete KVKK awareness training. Tailored training is delivered for units that process data.

7

Continuous Compliance Monitoring: A cycle of annual compliance audits, policy updates and employee training is established.

Key Features

Data Inventory (RoPA)

An inventory of data processing activities is created under KVKK Article 16, and registration is made with the Data Controllers Registry (VERBIS).

Compliance Gap Analysis

Gaps between the current state and KVKK requirements are identified. A prioritized action plan is prepared.

Technical Measures Implementation

Technical controls such as access log management, encryption, anonymization and data masking are put in place.

Policy and Procedure Package

A personal data processing policy, privacy notice, cookie policy and data subject rights procedure are prepared.

Breach Management Plan

Procedures for detecting and assessing data breaches, notifying within 72 hours and notifying data subjects are documented step by step.

DPIA Support

Data Protection Impact Assessments for high-risk data processing activities are carried out with methodology and documentation support.

Supplier Contract Management

Templates for data processing agreements (DPAs) to be signed with data-processing suppliers are prepared, and KVKK compliance is assessed.

Board Proceedings Support

Technical assessment and documentation support is provided for applications and defense proceedings before the KVKK Board.

Benefits & Advantages

A systematic compliance program provides assurance against administrative fines and legal sanctions.

Technical controls that reduce the risk of data breaches minimize the cost of damage from a potential breach.

Compliance documentation strengthens the trust of customers and business partners and creates a competitive advantage.

VERBIS registration and notification obligations are fully met, reducing regulatory pressure.

Employee training raises personal data awareness and reduces the risk of unintentional breaches.

The policies and procedures prepared also support compliance with other data protection regulations, GDPR in particular.

Industry Use Cases

Finance & Banking

As part of a bank's KVKK compliance program, VERBIS registration was completed, technical measures were strengthened and a Board inspection was passed with zero findings.

Healthcare

A private hospital's patient data processing workflows were brought into KVKK compliance; a DPIA was conducted for the health data category.

E-Commerce

A customer data platform was restructured with KVKK-compliant privacy notices, cookie management and data deletion processes.

Human Resources / Recruitment

The candidate data processing workflow was reviewed for legal basis and retention periods; legal compliance was achieved.

Retail

Loyalty program customer data was reassessed under KVKK and reconfigured in line with the data minimization principle.

Public Sector Institutions

An inventory of a municipality's citizen data processing activities was created; technical and administrative measures were implemented and all units completed training.

The Indexline Approach

KVKK compliance should be treated not as a mere checkbox exercise but as a strategic program that raises the organization's data management maturity. A compliance program built from this perspective does not stop at legal requirements; it strengthens data inventory, risk management and security controls in an integrated way.

Every organization's KVKK compliance journey is different. Data processing volume, industry, international data transfers and sensitive data categories are the main differentiating factors. Indexline assesses each organization's specific risk and designs a proportionate, actionable compliance program.

KVKK compliance is a continuous process, not a one-time project. Regulations change, data processing activities evolve and new systems go live. An annual cycle of compliance audits, policy updates and training keeps this process alive.

Frequently Asked Questions

Is VERBIS registration mandatory?

Data controllers with more than 50 employees annually or an annual balance sheet total exceeding TRY 25 million must register with VERBIS. Public institutions are also obliged to register. All data processing categories must be recorded.

When must we report a KVKK breach?

The KVKK Board must be notified within 72 hours of becoming aware of a data breach. Data subjects must be notified without delay and in an accessible manner. Having a breach response plan prepared in advance is critical in this process.

Is permission required to transfer data abroad?

Yes. Under KVKK Article 9, transferring personal data abroad requires the data subject's explicit consent, or an adequacy decision or approval of a letter of undertaking by the Board. If you have international data flows, the legal framework for transfers should be put in place in advance.

Is employee data also covered by KVKK?

Yes, employees' personal data is also covered by KVKK. The employer must fulfill its obligation to inform, document the legal basis for processing and make access rights exercisable.

What does KVKK require of small businesses?

Businesses with fewer than 50 employees and a balance sheet below TRY 25M are exempt from VERBIS registration; however, all other KVKK obligations apply. Core obligations such as notification, data security and data subject rights apply regardless of size.

What are the differences between GDPR and KVKK?

KVKK is largely inspired by GDPR, but there are some differences. GDPR makes appointing a data protection officer (DPO) mandatory for certain organizations, whereas KVKK does not provide for this. There are also differences in maximum fine amounts, notification periods and scope.

Which technical tools are used for compliance?

The main technical tools are dedicated PIMS software for data inventory (OneTrust, DataGrail), DLP tools, access log management, encryption solutions and DSPM (Data Security Posture Management). Tools are selected to fit the organization's existing infrastructure.

Within how many days must you respond to data subject requests?

Under KVKK Article 13, a data subject's request must be answered within 30 days. If the request is rejected, a reasoned response must be given and the data subject must be informed of their right to file a complaint with the Board.
